Overview#
CLOUD Act (Clarifying Lawful Overseas Use of
Data Act) was an
Act of Congress in
2018 amends
U.S.C. Title 18 Section 2523 the
Stored Communications Act (
SCA) of 1986 to allow
United States federal government Law Enforcement Agency to compel
United States-based technology companies via warrant or subpoena to provide requested
data stored on servers regardless of whether the
data are stored in the
United States or on
Foreign soil.
CLOUD Act has several interesting aspects in regards to Data Ownership and the Law of agency in that revealing data of an entity within a different Jurisdiction may violate the Law where the data resides.
CLOUD Act was introduced following difficulties that the Federal Bureau of Investigation (FBI) had with obtaining remote data through Service Providers through Stored Communications Act warrants.
